Terms of Service

These Terms of Service (“Terms”) govern your use of the Nexus messaging service (the “Service”) provided by [LEGAL ENTITY NAME] (“Nexus”, “we”, “us”), the operator of the Service. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required by the laws of your country, to use Nexus. By using the Service you confirm that you meet this requirement and that you are able to enter into a binding agreement.

2. Your account

You register using an email address (including via Google sign-in) or, where supported, a phone number, confirmed by a one-time code. You are responsible for the activity on your account and for keeping your device and sign-in method secure. Notify us promptly of any unauthorised use. You may choose a username and display name; you must not impersonate others or use a name that infringes someone’s rights.

3. The Service

Nexus lets you exchange messages, photos, videos, voice notes, files and reactions, make peer-to-peer voice and video calls, and manage a profile and contacts. We may add, change or remove features over time. The Service may occasionally be unavailable for maintenance or for reasons beyond our control.

We may remove content and suspend or terminate accounts that breach these Terms or applicable law.

Reporting, moderation and enforcement

You can report a message, a channel post, a user, a group or a channel from within the app, selecting a reason (spam, fraud, violence, pornography, copyright infringement, terrorism, harassment, or a free-text “other” reason). Reports are reviewed by our moderators through an internal moderation panel. Depending on the outcome, we may take graduated action: a warning, a temporary restriction, a temporary ban, or a permanent ban within the specific group or channel where the violation occurred.

A ban inside a group or channel does not disable your Nexus account: you keep using the rest of the Service. When you open a group or channel where you are banned, you will see the reason and, for temporary measures, the expiry date. Enforcement decisions are recorded together with who issued them, the affected user, the reason, the evidence, the date, the duration and the status, and are kept in our audit logs.

Official enforcement notices are delivered to you in-app from the relevant community. If you believe a decision is wrong, you can appeal it using the “Appeal” option on the notice; appeals are sent to our moderation team for review.

5. Your content

You retain ownership of the content you create and send. You grant us a limited licence to host, store, transmit and display your content solely to operate and provide the Service to you and your chosen recipients. You are responsible for the content you share and for having the necessary rights to share it. As described in our Privacy Policy, message content and attachments are stored on our servers and are not end-to-end encrypted at this time.

6. Calls

Voice and video calls are established peer-to-peer using WebRTC and rely on third-party connectivity (STUN/TURN) servers to set up the connection. Call quality depends on your network and devices, which are outside our control.

7. Third-party services

The Service interoperates with third parties such as Google (authentication), an email delivery provider (verification codes), call-connectivity providers, and your browser/operating-system push services. Your use of those services is also subject to their own terms and privacy policies.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms and explains what data we process and why.

9. Termination

You may stop using Nexus and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (such as content licence for already-transmitted messages, disclaimers, and limitation of liability) will survive termination.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that messages will always be delivered. Nothing in these Terms limits rights you have as a consumer that cannot be excluded under applicable law.

11. Limitation of liability

To the maximum extent permitted by law, Nexus will not be liable for indirect, incidental, special or consequential damages, or for loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Nothing in these Terms excludes liability that cannot be excluded under Czech or EU law (including liability for death or personal injury caused by negligence, or for fraud). Mandatory consumer-protection rights remain unaffected.

12. Changes to these Terms

We may update these Terms. We will post the updated version with a new “Last updated” date and, for material changes, provide notice within the Service. Continued use after changes take effect constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the Czech Republic, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes are subject to the competent courts of the Czech Republic, again without prejudice to your mandatory consumer rights. EU consumers may also use the European Commission’s Online Dispute Resolution platform.
